Banerjee) (Via Video Conference) Mr. Shamim ul Bari Mr. Ali Ahesan Alamgir Ms. Riya Das Ms. Rabia Khatoon ... for the petitioner Mr. Kanak Kiran Bandyopadhyay ... for the SSC The petitioner's main grievance in this writ application is this that he appeared in the recruitment test for upper primary teacher in school conducted by the West Bengal Central School Service Commission for the post of Physical Education/ Work Education. The petitioner applied for Work Education. He was an OBCA candidate. After receiving a reply under Right to Information Act, for which the application was made by the petitioner on 27.11.2019 and reply whereof was given on 12.11.2020, he has come to know that the lowest marks obtained by the candidate in OBC-A (M/F) & (F) category in Bengali medium who was called for verification-cum-P.T. was 66. The petitioner has submitted that from the answer key he has calculated his marks in the written examination, which is 39, and according to the tabular form for giving marks against educational qualification he is entitled to get 35 which

takes his marks to a total of 74, which is higher than 66 as the lowest marks. The petitioner only prays for consideration of his representation at page 46 of the writ application dated 04.12.2020 by the West Bengal Central School Service Commission.

I direct the Chairman, West Bengal Central School Service Commission, to consider the representation after considering the facts of the case and after giving an opportunity of hearing to the petitioner within a period of four weeks. A reasoned order is to be passed by the Chairman within a period of two weeks thereafter.

If it is found that the contention of the petitioner is correct, the Chairman shall take appropriate steps so that no sense of deprivation is generated in the mind of the petitioner.

With the observation as above, the writ application is disposed of.
