The petitioner has challenged the order dated November 15, 2006, in this writ petition. The Deputy Secretary (Records-II), the respondent no.3, West Bengal Board of Secondary Education has rejected the petitioner's prayer for change of surname in the certificate of Madhyamik Pariksha(Secondary Examination), 2003. The reason for the same is stated to be that change in surname consequent to the final examination, cannot be incorporated in Board's records.

It has been submitted that the purported action is only irrational and arbitrary, more so, even after calling for all necessary documents for scrutiny, in this regard, no steps have yet been taken by the Board. It appears that representation of the Board is necessary for proper adjudication of the case. However, no one is appearing for the Board today. Accordingly, learned advocate appearing for the petitioner is requested to effect service of notice upon Ms. Bhattacharyya, representing the Board.
