21.06.2021 AKG CRR 1022 of 2020 (Through Video Conference) In Re: - An application under Section 401 and 482 of the Code of Criminal Procedure, 1973.

And In the matter of: Habibulla Mondal @ Mintu .... Petitioner Mr. Sumanta Chakraborty ... For the Petitioner Mr. Arijit Ganguly, Mr. Sanjib Kumar Dan ... For the State This application has been filed for expeditious hearing of the criminal case being N. Case No. 181 of 2018 under Section 21 ( c ) of the Narcotic Drugs and Psychotropic Substances Act, 1985 pending before the learned Additional Sessions Judge, 6th Court at Barasat. Learned advocate appearing for the petitioner submits that out of the eleven witnesses, five witnesses have been examined so far. He says that the petitioner is in custody since September 22, 2018. Learned advocate appearing for the State submits that due to the pandemic situation, the trial of the case could not be proceeded with.

I find substance in the submissions advanced on behalf of the State that the delay in disposal of the proceeding cannot be attributed to the learned Additional Sessions Judge below, in this trying time. However, keeping in mind the nature of the innocuous prayer, I dispose of this revisional application giving a direction upon the

learned Additional Sessions Judge, 6th Court at Barasat, to make an endeavour to conclude the trial within a year from date without granting unnecessary adjournment to the parties. Accordingly, the revisional application being CRR 1022 of 2020 is disposed of (Kausik Chanda, J.)
