(DB) No. 1006 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Tehatta Police Station Case No. 621 of 2015 dated 01.12.2015 under Sections 302/120B of the Indian Penal Code and under Sections 25/27 of the Arms Act.

And In Re : Sohel Sk. @ Sohel Rana Sk. @ Guji ..... petitioner Mr. Asraf Mandal ... for the petitioner Mr. Sudip Ghosh Mr. Apurba Kumar Datta Mr. Bitasok Banerjee ... for the State Learned Counsel for the petitioner submits he is in custody for seven years. It is also submitted there is delay in trial. He prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Documents in support of plea that there is delay in trial are not present in the petition. Allegations are grave. Trial is in progress. Under such circumstances we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is, thus, rejected. Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
