Smt. Gouri Bala Majhi & Ors.

(Through Video Conference) Mr. Rabindranath Mahato.

... for the Petitioner.

Today none appears on behalf of the opposite parties. Even when the matter was dismissed for default none appeared on behalf of the opposite parties.

Affidavit-of-service shows that the copy of the restoration application was sent to the opposite parties on October 12, 2020 by a covering letter of the learned advocate for the petitioner.

CAN 1 of 2020 is an application for restoration of C.O.963 of 2018, which was dismissed for default on February 20, 2020.

Upon considering the grounds set out in paragraphs 3, 4 and 5, this Court is satisfied with the explanation given by the learned advocate for the petitioner as to why the petitioner could not attend the Court on the date the matter was dismissed for default.
