05.05.2022 Court No.13 Item No.18 AP WPA 6150 of 2022 Arati Chanda Vs.

The State of West Bengal and Ors.

(Through Video Conference) Mr. Tirthankar Roy ... For the Petitioner.

Mr. Amitesh Banerjee, Senior Advocate Ms. Ipsita Banerjee ... For the State.

This matter was mentioned citing urgency.

This Court sees no urgency in the matter. The dispute between the petitioner and the private respondent is purely civil in nature. The petitioner claims to have obtained a decree in a civil suit being T.S. No.40 of 2012, before the Ld. Civil Judge, Jr. Div., 1st Court, Ranaghat, against the private respondent brother. The private respondent brother in turn has filed T.S. No.30 of 2021, against the petitioner and the proceedings are pending. Apart from the fact that the issue is purely civil in nature, this Court sees absolutely no urgency whatsoever in this matter being mentioned for upgradation. The writ petition shall stand dismissed, with costs assessed at Rs.5,100/- payable by the writ petitioner to the State.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
