Since after the death of the husband of the petitioner, the petitioner would be entitled for family pension, unless is in-eligible for any other lawful reason. Her application dated November 8, 2016 for grant of family pension in place of her dead husband and also the subsequent application dated September 8, 2015 shall have to be considered by the Director of Pension, Provident Fund and Group Insurance, West Bengal.

The allegation as made by the petitioner in the present case is regarding the inaction of the said respondent in considering her prayer for grant of family pension, vide the applications as mentioned above. Let this writ petition be disposed of by directing the respondent no. 4/ Director of Pension, Provident Fund and Group Insurance, West Bengal to immediately consider and dispose of the petitioner's applications as above i.e. dated November 8, 2016 and September 8, 2015.

He shall pass a reasoned order if not, the prayer of the petitioner is allowed by him. In doing so, he shall grant a reasonable opportunity of hearing to the petitioner.

The exercise as above shall be concluded by the respondent no. 4/ Director of Pension, Provident Fund and Group Insurance, West Bengal within a period of ten days from the date of communication of copy of this order.

With the above observations and directions the writ petition being WPA 6627 of 2017 is disposed of. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
