The petitioner is in custody for more than a year and prays for bail.

Opposing the prayer, learned counsel for the State submits that one of the accused is still absconding for which the trial cannot be proceeded with.

I have considered the material on record.

The petitioner is the husband of the victim who expired within one year and eight months of her marriage in her matrimonial home. The petitioner who was residing with the victim at the matrimonial home owes an explanation to the circumstance which led to her death. In view of the incriminating material against the petitioner, prayer for bail is rejected at this stage. Learned trial Court is directed to consider splitting up of trial insofar as the absconding accused is concerned and expedite the trial without granting any unnecessary adjournment to either of the parties.

The application for bail is disposed of.
