Learned counsel for the parties produces copies of certificates of deposit accounts of the writ petitioner and his mother.

Particulars of five accounts have been produced. Four of such accounts standing in the name of the writ petitioner and his mother jointly. Two of such accounts, which have already matured and proceeds have been transferred to the savings bank single account of his mother. Two other deposit accounts, which have also matured proceeds whereof, have been transferred to the savings bank joint account of the writ petitioner and his mother. Last of such account standing in the name of the writ petitioner alone is yet to mature.

In view of the above, this Court is of the view that the writ petitioner is guilty of gross suppression of

material facts and misstatement thereof. The writ petition has been used as a tool for fishing evidence. Hence the writ petition is dismissed with costs assessed at Rs.5,100/- to be paid by the writ petitioner to the State Legal Services Authority.

The Indian Bank shall ensure that the aforesaid sum of Rs.5,100/- is, in fact, paid by the writ petitioner to the State Legal Services Authority.
