The grievance of the petitioners is directed against the failure of the respondent authorities to forward the application of the petitioners under Section18 of the Land Acquisition Act, 1894 before the Competent Court.

Mr. Sengupta appearing on behalf of the State submits that subsequent to the filing of the writ petition the appropriate authority has taken necessary steps and forwarded the copy of the application under Section 18 of the Land Acquisition Act filed by the petitioners before the Competent Court.

In view of the submissions made on behalf of the parties, I am of the view that nothing survives in this writ petition and the complaint of the petitioners has been appropriately dealt with.

Accordingly, WPA 7384 of 2021 stands disposed off.

I make it clear that I have not gone into the merits of the application under Section 18 of the Land Acquisition Act, 1894 and the Competent Court is at liberty to decide all the issues on the merits of the case including the point of maintainability and limitation of the Section 18 application without being influenced by any observation in this order and in accordance with law.
