The petitioner complains that the private respondents have encroached upon the 'Nayanjuli'

adjacent to the petitioner's land, thereby obstructing the egress and ingress of the petitioner. The petitioner submitted a representation ventilating his grievance before the District Magistrate, Nadia and other Authorities on 22nd August, 2019, but the said representation is yet to be disposed of. The petitioner prays for a direction upon the concerned Authority for disposal of the representation in terms of

Section 3 of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962.

Having considered the submissions made on behalf of the parties and the material on record, the writ petition is disposed of with a direction upon the 5th respondent to consider and dispose of the representation filed by the petitioner dated 22nd August, 2019 according to the provisions laid down under Section 3 of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962 within a period of three months from the date of communication of this order, after affording reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondents.

W.P.A. 5198 of 2020 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
