(Item No. 169) (AB) Mr. Anirban Majumder Mr. Somnath De ...... for the petitioner The petitioner claims to be a manufacturer of Hard Coke. He is aggrieved by the communication dated 14th November, 2019 issued by the Block Development Officer, Salanpur Development Block whereby he has been directed to submit the 'No Objection Certificate' from the Police for the purpose of renewal his trade license.

According to the petitioner, as per law, he is not required to produce the NOC from the Police for the purpose of renewal of trade license.

The petitioner, however, did not approach the respondent authorities with his submission that he is not required to produce the NOC from the police, as directed to be submitted by him.

None appears on behalf of the respondents despite service. Affidavit of service filed in Court is taken on record.

In view of the above facts and circumstances, leave is granted to the petitioner to approach the Block Development Officer, Salanpur Development Block, respondent no. 5 herein as to why he is not

required to submit the NOC for the purpose of renewal of his trade license.

In the event a representation is made before the concerned authority, the same shall be considered in accordance with law, after giving him an opportunity of hearing.

The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
