Petitioner has approached this Court for transferring the investigation to CBI.

I find that there was a dispute between Sk Sabir Hosen on one side and Prasenjit Das and Subrata Maji on the other side.

Based upon the complaint and the injuries sustained the Officer-in-Charge, Nandakumar Police Station started Nandakumar Police Station case no. 132/2025 dated 14.03.2025 under the relevant provisions of BNS, 2023. Another case has also been registered being Tamluk Police Station case no.208/2025 dated 15.03.2025 under the relevant provisions of BNS, 2023.

Both the cases, I find that they were initiated on 14.03.2025 and 15.03.2025. A counter case was also

registered being Nandakumar Police Station case no. 133/2025 dated 15.03.2025.

Having considered that all the cases have been registered very recently and not even a month have expired since then, the police authorities should be given an opportunity to investigate the case by putting in efforts. At this stage, I do not find any reason to interfere with the investigation or come to a finding whether a case for transfer of investigation has been made out. However, so far as the alternate prayers of the petitioner is concerned, the police authorities are directed to ensure that there should be free and fair investigation without any interference and all efforts must be exerted to unearth the truth in course of the investigation. With the aforesaid observations WPA 6426 of 2025 is disposed of.

Report so submitted by the State be kept with the record.
