The petitioner is in custody for about six months and prays for bail.
Learned counsel for the petitioner submits that the test identification parade and the alleged recovery pursuant to his statement were done much after his arrest. The seized articles have not been sent for forensic examination. Charge sheet has been submitted. His further detention is not required. Learned counsel for the State and the defacto complainant oppose the prayer.
I have considered the material on record.
The case pertains to brutal murder of a person. The petitioner has been identified in the test identification parade. The offending weapon has been recovered at his instance. The seized articles including the offending weapon have been sent for forensic examination. Report is awaited. The petitioner has several criminal
antecedents and according to the defacto complainant, is a noted criminal of the locality Considering the gravity of the offence and prima facie involvement of the petitioner in the offence, prayer for bail is rejected at this stage.
The application for bail is disposed of.
