There is an issue of long absconsion. Statement of the victim recorded under Section 164 of the Cr.P.C. squarely implicates the petitioner in the crime alleged. We requested the State to inform the defacto-complainant as to the pendency of the proceeding which the State did. The defacto-complainant is present in Court and identified by the learned advocate for the State.

In view of the materials in the case diary, gravity of the offence and the long absconsion of the petitioner, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail of the petitioner is rejected. Signed By :
