This is an application for vacating of order of stay passed by a Co-ordinate Bench vide order dated 15th June, 2022. It appears from the record that being aggrieved against an order dated 10th March, 2022 passed by the Learned Additional Sessions Judge, Fast Track First Court at Howrah staying the operation of the orders dated 16th February, 2022 and 18th February, 2022 passed by the Learned Judicial Magistrate, 1st Court at Howrah is assailed in the instant revisional application. At the time of hearing of the instant application, this Court proposed that the Learned Additional Sessions Judge, Fast Track 1st Court at Howrah may be directed to dispose of criminal appeal no.13 of 2022 within shortest period of time so that the interest of both the parties may not be tempered, to which the Learned Counsel for the parties have agreed.

Therefore, the Learned Additional Sessions Judge, Fast Track 1St Court, Howrah is directed to dispose of the criminal appeal no.13 of 2022 positively within 21st January, 2023. In the meantime, the order of stay granted by the Coordinate Bench on 15th June, 2022 shall be in force. Accordingly, CRR 1150 of 2022 alongwith application being, IA No. CRAN 2 of 2022 are disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Bibek Chaudhuri, J.)
