Tapash Bal Mr. Shibaji Kr Das, Mr. Dipendu Sarkar, Ms. Deblina De ...for the petitioner In this application the petitioner has prayed for expeditious disposal of M-Case No.95 of 2022 presently pending before learned Additional Chief Judicial Magistrate, Diamond Harbour. Petitioner's contention is that the petitioner filed an application under Section 125 Cr.P.C. which was registered as M95 of 2022 wherein maintenance amount to the tune of Rs.30,000/- per month was prayed for. The Trial Court after contested hearing, directed the opposite party to pay a sum of Rs.4,000/- per month in favour of the petitioner towards interim maintenance.
It is alleged by the petitioner that for a period of more than 3 years, in spite of fixing several dates, the Trial Court could not conclude the evidence of petitioner no.1 due to which she is suffering a lot and accordingly prays for appropriate direction upon the Court below for expeditious disposal of the said M. Case No.95 of 2022.
Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is
allowed in terms of the prayer made in the applcation, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with, Having considered the submission made by the petitioner, the instant application being CRR 1262 of 2026 is hereby disposed of with a direction upon the Court below to make its best endeavour for expeditious disposal of the proceeding and to conclude the entire proceeding preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties. This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
