This revisional application has been filed by the husband/petitioner in Matrimonial Suit No.3119 of 2019 pending before the learned Additional District Judge, 6th Court, Alipore, District 24-Parganas (South), praying for expeditious disposal of the suit, the Misc. Case No.571 of 2019 and also the pending application under Section 151 of the Code of Civil Procedure.

Having regard to the nature of the prayer, this revisional application is disposed of with a direction upon the learned Court below to dispose of the pending application filed under Section 151 of the Code of Civil Procedure in connection with the misc. case within a period of one month from the next date fixed upon affording one last opportunity to the opposite party to contest the application. Upon disposal of the application, the learned Court below shall make serious

endeavour to dispose of the misc. case as also the matrimonial suit within a year thereafter.

This order is being passed without going into the merits of the suit and also the pending application and the learned Court below shall proceed in accordance with law, without granting unnecessary adjournments to either of the parties. The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application upon the opposite party along with a server copy of this order immediately.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
