Learned advocate appearing for the petitioners submits that from an abandoned place 149 bottles of phensedyl was recovered and the petitioners have been implicated in the said case. Petitioners were arrested on 20th of September, 2025 and charge-sheet has already been submitted after the investigation has been concluded. Learned advocate for the State opposes the prayer for bail. I have taken into account the period of detention of the present petitioners which is more than six months and that the investigation has already been concluded.

Having considered the overall circumstances and the prosecution intends to rely upon nine witnesses in support of this case which will consume sometime, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners are allowed.

Accordingly, petitioners namely, Subhankar Mandal and Chiranjit Mandal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional District Judge, 3rd Court, Special Court, Malda.

If on bail, the petitioners shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 515 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
