These four revisional applications since are arising out of the selfsame suit between the same parties, are taken up for analogous consideration.

In Re: C.O. 44 of 2009 & C.O. 866 of 2007 Mr. Bhattacharya appears on behalf of the petitioners in C.O. 44 of 2009 and C.O. 866 of 2007 and submits that his clients are not willing to press the revisional applications, he files written instruction of his clients to the said effect; let those instructions be kept with the record.

In view of such stand of the petitioners C.O. 44 of 2009 and C.O. 866 of 2007 are dismissed as not pressed without any order as to costs.

In Re: 3876 of 2010 The instant revisional application is arising out of Title Appeal No.3 of 2009 pending before the learned District Judge, Cooch Behar.

The defendant/respondent no.8 aggrieved by an order of injunction passed in the said appeal has preferred the instant revisional application.

The main grievance of the petitioner is that the order of injunction was passed without condoning the delay in filing the appeal.

The Appeal Court below by the subsequent order No.34 dated July 25, 2014 has condoned the said delay.

In view of such development, challenge to the order impugned has become infructuous. C.O. 3876 of 2010 is, therefore, dismissed as such without any order as to costs.

C.O. 3765 of 2014 with CAN 3 of 2025 In Re : CAN 3 of 2025 The petitioner has filed an application for modification of the order passed on May 16, 2024. Let the application be placed before the Hon'ble Judge who had passed the said order.
