A report has been submitted by the Investigating Officer through the learned Public Prosecutor, High Court, Calcutta appearing for the State in this matter. Let the report be kept with the record. The report reflects that final report has been submitted before the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas on 25th January, 2021 in connection with Jadavpur P.S/Anti-
Fraud/D.D Case No.43 of 2020 dated 05-02-2020 under Sections 120B/420/409/467/468/471 of the Indian Penal Code, praying for discharging the accused persons.
In view of the aforesaid, the applications for anticipatory bail have become infructuous.
Earlier, a co-ordinate Bench of this court was pleased to direct the petitioner(s) to deposit their passports with the Investigating Officer. In view of the final report being submitted discharging the accused, the said passports may be returned to the concerned persons/petitioners on any condition the Investigating Officer may deem fit and proper.
Mr. Ghose, learned senior advocate appears on behalf of the petitioners.
Mr. Banerjee, learned advocate appears on behalf of the de facto complainant and sought for some time. However, because of the final report being submitted in this case, his prayer is refused. In view of the averments made in the petitions relating to look out circular being issued, the Investigating Officer of the case is directed to take steps so that the same may be recalled through the concerned department.
In view of the aforesaid observations, the applications for anticipatory bail being CRM 2770 of 2020, CRM 2877 of 2020, CRM 2878 of 2020 and CRM 2879 of 2020 are disposed of accordingly. CRAN application, if any, stands disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
