The petitioner is in custody for about 485 days in connection with the aforesaid case. 5 litre of codeine mixture was recovered from the joint possession of the petitioner which is admittedly a commercial quantity.

Learned Counsel for the State opposes the prayer for bail. Though the charge sheet has already been submitted but in view of the recovery of the contraband above the commercial quantity, we do not find any ground for taking exception to the rigor of Section 37 of the NDPS Act.

The application for bail is considered and is rejected. CRM 2612 of 2021 is accordingly dismissed.
