Petitioner is aggrieved in respect of the 14.05.2025 Court No. 35 Item No.9 Rakib representation furnished with the Officer-in-Charge, Howrah Police Station on or about 08.07.2022.

Petitioner's main grievance is that he has paid substantial sum of money (Rs.5,00,000/-) and inspite of receipt of the sum of money, the flat was not handed over to the petitioner but sold to a different customer.

Learned advocate for the State has submitted a report.

However, having regard to the fact that the police authorities have stated that Howrah Police Station could not initiate a case because of noncooperation of the petitioner, I am of the view that petitioner would approach the concerned police station with fresh representation and the documents in his custody, police authorities would thereafter act in accordance with law.

Learned advocate appearing for the respondent no.4 claims that respondent no.4 is a buyer who is a bona fide purchaser by paying the requisite amount. Be that as it may, police authorities will consider any fresh representation it is submitted by the petitioner in accordance with law.

With the aforesaid observations WPA 6631 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report has been handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
