The present revisional application has been preferred challenging the continuance of Nabadwip Police Station Case No. 278 of 2020 dated 04.08.2020 wherein charge-sheet has been submitted under Sections 465/468/474 of the Indian Penal Code.

I do not find that the documents under Section 207 of the Code of Criminal Procedure being enclosed in a case where charge-sheet has been submitted before the jurisdictional court. Having considered the same, I am of the view that the petitioner would be at liberty to take up the issues canvassed in the present revisional application along with the additional grounds by way of preferring an application under Section 239 of the Code of Criminal Procedure before the jurisdictional court. The learned trial court would consider the said application in accordance with law without being influenced by any observations made by this Court while disposing of this revisional application. With the aforesaid observations, the revisional application being CRR 1000 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
