Mr. Parameswar Pramanik, Probationary Sub-Inspector of Police has appeared before this Court in person with an explanation forwarded by the Superintendent of Police, Hooghly. The Police Officer had submitted a report that he had served upon a dead person, Saugata Neogi, who has expired in the year 2016.

In view of such report and on perusing of the Death Certificate of the person concerned an explanation was called for with the views of the District Police Administration.

Mr. Arnab Ghosh, Commissioner of Police, Chandannagar Police Commissionerate has submitted his report that Mr. Parameswar Pramanik made a gross mistake in submitting the compliance report without verifying the whereabouts of the person and he has been 'censored'.

Mr. Parameswar Pramanik, Probationary Sub-Inspector of Police has prayed for unconditional apology. The report is accepted and kept with the record. Mr. Parameswar Pramanik, Probationary Sub-Inspector of Police is cautioned that in future he should comply with the Court's order with due diligence and not in routine manner without verification, failing which stringent steps have to be taken by his department.

Personal appearance of Mr. Parameswar Pramanik, Probationary Sub-Inspector of Police is dispensed with.

The petitioner filed this revisional application praying for quashing/setting aside of order dated 09.12.2014 passed by Learned Additional Sessions Judge, 1st Court, Hooghly in Criminal Motion No.180 of 2011 in connection with C.R. Case No.202 of 2009 pending before Learned Judicial Magistrate, 3rd Court, Chandernagore. Since the sole petitioner, Saugata Neogi has expired in the year 2016, this revisional application has become infructuous and the same is disposed of.

Interim order, if any, stands vacated.

Let a copy of this order be sent to Learned Additional Sessions Judge, 1st Court, Hooghly and to Learned Judicial Magistrate, 3rd Court, Chandernagore for information.
