The Officer-in-charge, Bagdah Police Station has filed a report dated 8th December, 2022 addressed to the Government Pleader, High Court, Calcutta. The same is taken on record.

It appears from the said report that Nirupama Biswas, the respondent no.7 herein is an Indian National holding the Indian Passport. It further appears from the said report that the said Arun Kumar Mondal and Amit Mondal, son of Adhir Chandra Mondal are also the Indian citizens born within the jurisdiction of the Bagdah Police Station and their father had come from Bangladesh. It also appears from the said report that Nirupama Biswas's mother, namely, Shanti Mondal was also examined and she is now permanently residing in India.

In such circumstances, this Court is of the view that the Nationality of Nirupama Biswas cannot be questioned any further.

However, in the event of any fraud otherwise committed by Nirupama Biswas in obtaining the passport, the petitioner may take up the matter with the Central Government of the Regional Passport Authority. Any other grievances and proceeding between the petitioner and the said Nirupama Biswas may continue in accordance with law.

With the aforesaid observations and taking into consideration the entire report of the Bagdah Police Station, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
