Learned advocate appearing for the petitioners submits that the petitioner nos.1 and 2 are in custody for 112 days and the petitioner no.3 is in custody for 108 days. Learned advocate further submits that similarly placed accused persons have been granted bail and the petitioners are unnecessarily languishing in jail as other accused persons are absconding. There is no possibility of the trial commencing in near future, as such, the petitioners may be released on bail.

Learned advocate for the State has produced the case diary and submitted that subsequently a supplementary chargesheet has been submitted on 8th May, 2026. I have taken into account the statement of the injured

under Section 164 of the Cr.P.C./183 of the BNSS. Having considered that the present petitioners were not available in course of investigation and were evading the process of law, at this stage, I am not inclined to release the petitioners on bail. Learned court in seisin of the case will exhaust the process of law so far as the absconding accused persons are concerned and take steps for committing the case to the court of sessions. At this stage, the prayer for bail of the petitioners in CRM(M)739 of 2026 is dismissed.

Petitioners would renew their prayer for bail after the case is committed to the court of sessions.
