14.03.2024 sdas rejected C.R.M.(NDPS) No. 493 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Sagardighi Police Station Case No. 558 of 2022 dated 17.11.2022 under Sections 20(b)(ii)(c )/29 of the NDPS Act.

Learned Counsel for the petitioner submits she is in custody for one year and three months. She prays for bail. 2.

Learned Counsel for the State opposes the bail prayer.

We have considered the materials on record. 108 Kgs. of Ganja were recovered from the petitioner and coaccused. Bail prayer of the petitioner and co-accused was rejected in September, 2023 on merits. Charge has been framed and date has been fixed for recording evidence. In view of the aforesaid incriminating materials and statutory restrictions under Section 37 of the NDPS Act we are not inclined to grant bail to the petitioner.

Application for bail is, thus, rejected.
