Mr. Apurba Krishna Das ... for the petitioner This application under Article 227 of the Constitution of India is at the instance of the respondent in Title Appeal No.38 of 2015 praying for a direction upon the learned Additional District Judge, 1st Court at Alipore to dispose of title appeal expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Judge of the 1st Appellate Court.

From the order-sheets appended to this civil revisional application this Court finds that 1st of March, 2025 was fixed for hearing of the appeal. Learned advocate for the petitioner submits that the hearing of the appeal was not taken up on

that day and the same was adjourned to May 15, 2025.

In the light of the submissions made by the learned advocate for the petitioner, C.O. 1029 of 2025 is disposed of by requesting the learned Additional District Judge,1st Court at Alipore to take up the hearing of Title Appeal No. 38 of 2025 on the next date fixed.

Considering the fact that the title appeal is of the year 2015, the learned Judge of the 1st Appellate Court is requested to dispose of the same preferably by the end of September, 2025 without granting any unnecessary adjournment to either of the parties. No order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
