This is an application seeking transfer of a proceeding from the Court of the learned Additional Chief Judicial Magistrate, Asansol, Paschim Bardhaman to the Court of the learned Additional Chief Judicial Magistrate, Durgapur, Paschim Bardhaman.
The main contention of the petitioner was that since the opposite party no.2 was an influential lawyer practicing at Asansol, Paschim Bardhaman, the petitioners were unable to avail of the services of any advocate in Asansol. On his prayer the records of the case was called for by special messenger.
Learned Counsel appearing on behalf of the petitioners submits as follows. The petitioners have now been able to avail of services of learned advocates at Asansol, Paschim Bardhaman. As such, their grievances that had prompted them to seek transfer of the case have been addressed. Accordingly, the petitioners do not want to press this application.
Learned Counsel appearing on behalf of the opposite party no.2 files an information slip, which is taken on record. He submits that learned Counsels indeed appeared on behalf of the present petitioners on the last occasion before the learned Trial Court and the petitioners were granted bail.
No one appears on behalf of the State.
On the prayer of the learned Counsel appearing on behalf of the petitioners, the revisional application is dismissed as not pressed. The office is directed not to take any further steps for bringing the records of the case. In the event the records are already in transit, they would be sent back once they reach the Office of this Court. Urgent Photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
