Ms. Kaustav Bagchi Mr. Debayan Ghosh Ms. Priti Kar ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 3rd Court at Paschim Medinipur to dispose of the O.S. No.34 of 2013 expeditiously.

Mr. Bagchi, the learned advocate appearing for the petitioner submits that previously directions were passed by the co-ordinate Bench for expeditious hearing of the suit.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.

From the order sheets appended to this application this Court finds that several dates were fixed for argument

of the defendant. It appears from the order dated February 25, 2025 that April 23, 2025 has been fixed for argument of the defendant.

Since the suit is at the argument stage, CO 1025 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 3rd Court at Paschim Medinipur to take up the hearing of the suit on the next date fixed i.e., on April 23, 2025 and to dispose of O.S. No.34 of 2013 as expeditiously as possible and preferably by the end of May, 2025 without granting any unnecessary adjournments to either of the parties.

This direction has been passed taking into consideration the fact that the suit is of the year 2013 and the same is at the argument stage.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
