Mr. A.K. Maity (Mohanty) Mr. Amajit Dey .... For the C.B.I. Affidavit in opposition filed by the Central Bureau of Investigation is taken on record.

The petitioner has not filed any reply.

The accused is in custody for over eight years. Investigation is long over.

Chargesheet has been submitted and charge framed. 25th April, 2023 is the date fixed for trial. There is nothing on record to show that the accused would tamper with evidence or interfere with the witnesses or flee from justice.

The prosecution intends to examine eighty witnesses. Mr. Maity, learned advocate for the Central Bureau of Investigation submits that the trial be conducted on a day to day basis so that his client may obtain a conviction order as early as possible. Such prayer is allowed. The learned court below is directed to conduct the trial on a day to day basis as far as practicable. The accused is directed to be present in court on each and every day of trial unless exempted by the court. Considering the facts and circumstances above, subject to the above condition, the petitioner should now be enlarged on bail

upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Judge, CBI(1) Court, Bichar Bhawan, Calcutta subject to the following conditions:-

1. The petitioner is to deposit his passport, if he has one, with the investigating agency within three days from date;

2. He will meet the investigating officer as and when summoned.

3. He shall not leave the limits of Kolkata without informing the investigating officer.

4. He shall not tamper with evidence or interfere with the witnesses in any manner.

5. The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench. (Biswaroop Chowdhury J.) (I.P. Mukerji, J.)
