The petitioner seeks transfer on the medical ground of his child who is suffering from speech and hearing disability. The application seeking transfer is pending consideration at the end of Secretary, West Bengal Board of Primary Education.

Without entering into the merits of the claim of the petitioner, the instant writ petition is disposed of by the directing the Secretary, West Bengal Board of Primary Education to consider the said application in accordance with law, at the earliest, but positively within a period of eight weeks from the date of communication of this order.

Report of the CMOH and the disability certificate shall be taken into consideration at the time of taking a decision in the matter.

The fate of the petitioner's application shall be made known to the petitioner immediately thereafter. 6.
If the application of the petitioner is allowed, then necessary consequential steps shall be taken without any further delay.
7.
Suspension of the Utsoshree portal will not stand in the way of consideration of the application seeking transfer.
8.
Learned advocate of the petitioner is directed to forward a copy of the application seeking transfer along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
10.
All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
