Mr. Bhaskar Chandra Manna ... For the petitioner. Mr. Supriyo Chattopadhyay, Sr. Govt. Adv., Mr. Suman Dey ... For the State. The petitioner is the divorced daughter of a deceased Group - D Staff of Brahma Girls' High School, Contai, District - Purba Medinipur.
The petitioner is complaining non-disbursement of the family pension.
Mr. Chattopadhyay, learned senior Government Advocate submits that the District Inspector of Schools (SE), Purba Medinipur, the respondent no. 3 herein by his letter bearing Memo No. 146-Law dated February 23, 2023 has requested the petitioner to submit the following documents through the concerned school to process her prayer for family pension :-
1. Authenticated copies of Legal Heir Certificate of the petitioner issued by the District Magistrate, Purba Medinipur.
2. PPO Copy of Late Jhareswar Manna, Gr.-D of Brahma Girls High School.
3. Income Certificate issued against the petitioner by the Executive Officer of the concerned Block/Municipality.
4. Filled up prescribed Pension Booklet with documents asa. Forwarding letter of HOI of the concerned school (Original).
b. Death Certificate of parents Xerox (Attested). c. Voter ID, Pan Card, Aadhar Card of the claimant - Xerox (Attested).
Mr. Chattopadhyay files the photocopy of the said letter, let it be kept with the record.
Mr. Manna, learned advocate for the petitioner submits that within ten (10) days from date his client shall submit the aforementioned documents with the respondent no. 3 through the school.
The respondent no. 3 is directed to expedite the disposal of the family pension of the petitioner on receipt of the said documents in accordance with law. W.P.A. 7447 of 2021 is thus disposed of without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
