1. Challenging the action taken by the secured creditor for recovery of dues, the present writ petition has been filed.

2. Record reveals that notice under section 13(4) of the SARFAESI Act has already been issued.

3. In view of the existence of efficacious alternative remedy, I am of the view that the present writ petition cannot be entertained and the same is accordingly dismissed.

4. However, there shall be no order as to costs.

5. This order shall not preclude the petitioner from approaching the petitioner to appropriate forum in accordance with law.
