The grievance of the petitioner pertains to nonconsideration of a representation dated March 18, 2020 being annexure P-5 at page 22 of the writ petition. It is submitted on behalf of the petitioner that notwithstanding receipt of this representation the respondent No. 5 has taken no steps to dispose of the same.

Counsel on behalf of the Kolkata Municipal Corporation is represented and submits that he has no objection if the respondent No. 5 is directed to consider and dispose of the representation of the petitioner. He further submits that there are huge outstanding taxes due and payable by the petitioner and this is simply a mechanism to delay and procrastinate the matter. In view of the submissions made on behalf of the parties, the respondent No. 5 is directed to consider and dispose of the representation of the petitioner within a period of eight weeks from this date.

The respondent No. 5 is at liberty to grant a right of hearing to the petitioner, if he deems fit and necessary. The respondent No. 5 is further directed to communicate the decision on the representation of the petitioner within a period of two weeks from the date of taking such decision.

I make it clear that the respondent No. 5 will not be influenced on the merits of the case by any observation contained in this order.

Since no directions have been given for filing of affidavit, all the allegations contained in the petition are denied With the aforesaid directions, W.P.A. 5285 of 2020 is disposed of.

However, there will be no order as to costs.
