The petitioner also submits that a proceeding under Section 163(2) of the BNSS has been preferred before the learned Executive Magistrate wherein the learned Executive Magistrate passed necessary directions.

A report has been submitted by the learned advocate for the State which reflects that a civil suit being TS 1172 of 2024 is pending before the learned Civil

Judge (Jr. Divn.), 5th Court, Alipore.

There are also accusations of illegal construction and to that effect intimation has been sent by the police authorities to the Executive Engineer, Building Department, Borough- XIII, KMC for taking necessary action.

The police authorities have adhered to the provisions of law, they would continue their surveillance as also ensure that no breach of the peace and/or tranquility takes place because of the strained relationship existing between the petitioner and the respondent nos. 4 and 5.

With the aforesaid observations, WPA 6487 of 2025 is disposed of.

Pending application, if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
