In pursuance of the direction passed by this Court, the representative of the appellant company, i.e., Mr. Kumar Sidharth, Director of the Company is present before this Court. 2.

Nobody is present on behalf of the appellant. 3.

In pursuance of the direction passed by this Court, report submitted by the Commissioner of Police, Kolkata be kept with record. The report indicates that during pendency of this appeal, respondent/opposite party no.1 has passed away on 29th December, 2018, but no certificate of death was collected by the concerned police station. The death of the respondent no.1 was confirmed by his son as it appears from the report. 4.

This appeal is filed at the behest of the appellant company, challenging the impugned judgment and order of acquittal passed by the learned Trial Court in connection with Case No.C/677/95. As the respondent no.1/accused respondent has already been expired, the instant case becomes infructuous. 5.

It is orally submitted by Mr. Kumar Sidharth that the company does not intend to proceed further with the case.

As the sole accused person has been expired during pendency of this appeal, the instant appeal stands abated against him.

Accordingly, the instant appeal be and the same is hereby dismissed as abated.

Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
