Service report filed by the State is taken on record. Learned Advocate for the petitioner submits that the petitioner stands on the same footing as of Surya Debnath, who has already been enlarged on bail by this Hon'ble Court. There are no such incriminating materials against the petitioner, who is languishing for judicial custody for more than 9 months. He seeks for enlargement of the petitioner on bail. Opposing such prayer for bail, learned Advocate for the State submits that the petitioner is the manager of the brothel where the prostitution was being carried on. Incriminating materials have been seized from the possession of the petitioner.
Petitioner does not stand on the same footing as that of Surya Debnath, who was a customer. He seeks for dismissal of the application.
Perused the case diary and the materials on record. It is found that the present petitioner is the manager of the brothel where the minor victims were used for prostitution. This petitioner does not stand on the same footing as that of the accused who has been granted bail by this Court. Considering such materials and gravity of the offence, I am not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected. The application for bail being CRM (DB) 1058 of 2025 stands dismissed.
