The writ petitioner claims that notwithstanding her complaint to the Ausgram Police Station, DistrictPurba Bardhaman, of the acts and omissions of the private respondents, no steps have been taken till date.

Report in the form of instructions of the Inspector-in-charge, Ausgram Police Station, dated 9th April, 2022 addressed to the learned State Advocate, High Court, Kolkata be taken on record.

It appears from the said report that on 6th February, 2022, an FIR has been registered being Ausgram Police Station Case No. 96 of 2022 dated 6th April, 2022.

It is expected that the investigation into the aforesaid FIR, is completed within a period of two months from date.

The petitioner undertakes to co-operate with the investigation.

Counsel for the private respondents submits that the petitioner's fear that her son will be prevented from sitting in CBSE Examination at a centre in the locality is unfounded.

It is, however, made clear that in the event the petitioner complains to the Ausgram Police Station of any such obstruction towards her son in taking the examination, the Inspector-in-Charge, Ausgram Police Station shall render all necessary assistance to the petitioner and her son to ensure that the latter is able to freely appear for his examination.

This Court directs the Inspector-in-Charge, Ausgram Police Station, to ensure that there is no breach of peace in the area. The ownership and title of the flat in question which the petitioner claims she was residing in, falls within the ambit of a civil dispute, which this Court cannot enter into.

If approached, the Inspector-in-charge, Ausgram Police Station, shall take necessary steps for protecting the petitioner and her son, in accordance with law. With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
