1. Let affidavit-of-service, as filed in Court, be kept on record.
2. The petitioner is aggrieved that her application for mutual transfer, in spite of getting the requisite recommendation, has not been acted upon.
3. Mr. Jana, learned Advocate appearing for the petitioner, submits that the ostensible reason for not acting upon the recommendation is an error in the spelling of the petitioner's name in such recommendation letter.
4. Ms. Bhattacharyya, learned Advocate appearing for the Board, submits that the Board would merely act on the recommendation letter and there is clearly an error and hence there is a discrepancy in the recommendation letter and the approval for appointment of the petitioner as an Assistant Teacher on mutual transfer dated
March 10, 2021. She also submits that this error resulting in the discrepancy is not in the domain of the Board and can only be addressed by the Commissioner. In fact, by a letter of December 1, 2025, the Board has written to the Commissioner of School Education to clarify the issue regarding the spelling of the petitioner's name.
5. Commissioner of School Education is not represented in spite of several requests and reminders to appear while this matter was taken up.
6. Respondent no. 2 is directed to respond to the letter of December 1, 2025, issued by the Board, and clarify the situation regarding the error in spelling of the petitioner's name and thereby overcome the discrepancy in the letter of appointment and the letter of recommendation, both of which have been issued by the respondent no. 2.
7. This entire exercise will be completed by July 15, 2026 by the respondent no. 2 and will be intimated to the petitioner as well as the Board and the concerned District Inspector of Schools (S.E.) by July 20, 2026.
8. With the aforestated directions, the writ petition is, thus, disposed of.
9. There shall, however, be no order as to costs.
10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
