09.03.2021 rc/ct.no.10 Item No.13 WPA No. 5300 of 2020 Mr. Bidyut Halder ...for the Petitioner Mr. Rajiv Lal ....for the CESC Limited The grievance of the petitioner is directed against the refusal on the part of the CESC Limited to supply a fresh electricity connection to the petitioner.

It is submitted on behalf of the petitioner that notwithstanding having made such application for domestic connection in March, 2020 the CESC Limited have failed to take any steps to supply any connection to the petitioner.

The CESC Limited is represented and submits that the petitioner is carrying out commercial activities at the subject premises and is not entitled to a domestic connection but a commercial connection. It is further submitted that there is another domestic connection at the said premises which had been disconnected more than 15 years ago.

In view of the submissions made on behalf of the parties, the CESC Limited being the respondent no. 1 herein is directed to provide a commercial connection at the premises of the petitioner subject to compliance with all formalities in accordance with law.

In respect of the old meter which has been disconnected 15 years ago, the respondent no. 1 is at liberty to take all necessary steps in accordance with law. It is made clear that if the petitioner makes a fresh application for a commercial connection at the subject premises within a period of one week from date, the respondent no. 1 will consider such application and take all necessary steps for providing a new commercial electricity connection within a period of four weeks from date on receipt such application.

With the aforesaid directions this writ petition being WPA No. 5300 of 2020 is disposed of.

There shall, however, be no order as to costs. (Ravi Krishan Kapur,J)
