Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 670 bottles of phensedyl from two other accused persons who have been granted bail. Petitioner has been shown arrested on the basis of statement of co-accused and is in custody since 31.10.2025. Learned advocate for the State submits that charge-sheet has been submitted, charges have been framed and witness action would commence on and from the next date fixed. Prosecution has relied upon 11 witnesses, some time will be consumed to take the trial to its logical conclusion.
Having considered the locus of the present petitioner, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.
As such, petitioner namely, Manarul @ Minirul Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum learned Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 532 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
