Ms. Sibangi Chattopadhyay Mr. Sourav Mondal ...for the Petitioner This is an application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of G.R. case no. 3473 of 2022, presently pending before the learned Judicial Magistrate, 4th Court, Barrackpore.

Being aggrieved by the inordinate delay caused in disposal of the criminal proceeding, learned counsel for the petitioner submits that the FIR was lodged on 22nd July, 2022 and after a long time, the charge-sheet has been submitted on 31st July, 2023. Thereafter, only on 16th October, 2025, the charge has been framed against the accused person and the Trial court has fixed 3rd November, 2026 for evidence on behalf of the prosecution. She further submits that the prosecution proposes to examine only five witnesses. Therefore, she sought for preponement of date and for necessary direction.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having heard learned counsel for the petitioner, it appears that the court below after framing of charge has fixed the next date after about one year, which is not desirable in disposing such type of cases. Therefore, the prayer made by the petitioner is justified and is required to be allowed for securing the ends of justice.

Having considered so, the instant application being CRR 1320 of 2026 is hereby disposed of with a direction upon the court below to prepone the next date of recording evidence and to fix a date in the month of June, 2026 and to make best effort to conclude the trial preferably within a period of six months thereafter.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
