Item No.316 In The High Court At Calcutta Special Jurisdiction Appellate Side 23.03.2023 Ct-24 CPAN 371 of 2022 Ashis Das & Anr.

v.

Jayashree Roy in WPA 6708 of 2017 Mr. Siddhartha Sankar Mondal Mr. Tirthapati Acharyya ... for the petitioners.

Mr. Amitava Chaudhuri Mr. N. Roy ... for the contemnor.

The order dated October 1, 2021 has not been complied till date.

Learned advocate representing the alleged contemnor submits that an appeal has been preferred against the order passed by this Bench along with an application seeking condonation of delay of more than 300 days in filing the appeal.

The matter relates to compassionate appointment in a college affiliated to the Kalyani University. As it appears that the order passed by this Court has not yet been set aside/stayed or modified by any Court of competent jurisdiction, accordingly, the order is liable to be complied with without any further delay. The contempt application is directed to appear in the list once again on April 20, 2023 and an affidavit-of-

compliance shall positively be filed on the adjourned date.

In the event, the order is not complied with and the affidavit-of-compliance is not made ready by the adjourned date, the alleged contemnor shall be liable to remain personally present in Court on the adjourned date.
