The Assistant Director of Fisheries(Marine) shall take a decision on the basis of the letter written by the Pradhan of Mathurapur Purba Gram Panchayat dated February 1, 2023. Whether the guidelines under 'Muktadhara' scheme, would be applicable in case of the petitioners and whether they would be entitled to the benefits or not, shall be decided.

Such decision shall be arrived at upon granting an opportunity of hearing to the petitioners and upon holding an inspection in the presence of the petitioners, the Pradhan of Mathurapur Purba Gram Panchayat and all other relevant parties. A report of such inspection shall be prepared and provided to the petitioners. The petitioners will be entitled to respond to such report. Thereafter, a hearing shall be given and a reasoned order shall be passed and communicated to all.

This Court has not gone into the merits of the claims of the petitioners. The authority shall decide the entire issue on the basis of the guidelines. The entire exercise shall be completed within a period of three months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
