This revisional application has been filed praying for expeditious disposal of Misc. Case No.12 of 2011 pending before the learned Additional District Judge, IV Bench at Barasat, District 24 Parganas (North), West Bengal. It is the contention of the petitioner, the sole trustee, that an application for appointment of trustees under Section 74 of the Indian Trust Act, 1882 has been pending before the learned court below since a long time and the trust property was suffering on account as there were inadequate officials to manage the same.

Having considered the records, this Court is of the opinion that justice would be sub-served if the learned court below be directed to dispose of the misc. case within a period of four months from the next date fixed.

This Court has not gone into the merits of the contention of the petitioner and the learned court below shall decide the issue in accordance with law and on the basis of the documents before the learned court below. Revisional application is disposed of.

There shall be nor order as to costs.

Petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite parties as also the learned advocate appearing on behalf of the opposite parties in the learned court below. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
