The writ petition was preferred with a prayer so that appropriate directions may be passed upon the police authorities restraining the private respondents from encroaching the property of the petitioner.

Mr. Sengupta, learned advocate appearing on behalf of the State submits that a long standing dispute is pending between the petitioner and the private respondents. To that effect, it has been pointed out on behalf of the State that there has been a specific contention of the petitioner in the writ petition that on 10.10.2023 application for correction of the records and uploading the same was applied for at the behest of the petitioner.

Learned advocate for the respondent nos.14 and 19 is present and submits that the nature of dispute is absolutely a civil dispute and there is no scope for the writ court to interfere in such proceeding.

Having regard to the nature of the representation, I am of the opinion that the police authorities have a limited scope for interference. As such, the police authorities would only ensure that there is no breach of the peace and/or tranquility over the dispute relating to the property.

With the aforesaid observations, WPA 7116 of 2024 is disposed of.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
