1. The instant matter was placed before the mediator for mediation at the behest of the petitioner. During mediation, the matter was settled. The settled amount has already been received by the opposite party no. 2 and concedes that the matter has been settled after mediation. The opposite party no. 2/complainant is satisfied with full and final payment.

2. There is no impediment to allow the prayer for set aside the conviction.

3. The judgment and order of conviction dated 28th March, 2017 passed by the Learned 11th Metropolitan Magistrate, Calcutta in Complaint Case No. C/12413/2009 and affirmation of such order passed by the Learned Additional Sessions Judge, Fast Track Court-II, Calcutta is hereby set aside.

4. Consequently, CRR 896 of 2018 is, thus, disposed of.

5. CRAN 1 of 2018 (Old CRAN 2227 of 2018) is also, thus, disposed of.

6. Let a copy of this order be communicated to the Learned Courts below for information.

7. Urgent photostat certified copy of this Order, if applied for, is to be given as expeditiously to the parties on compliance of all legal formalities.
