Mr. Subhankar Chakraborty Mr. Saptarshee Bhattacharjee ....for the petitioners Mr. Nilotpal Chatterjee Mr. Satyaki Banerjee ....for the Calcutta University The University submits that on account of Provident Fund including interest up to September 30, 2022, a sum of Rs. 1,58,124 (Rupees One lac fifty eight thousand one hundred twenty four only) and under the head "Gratuity" a sum of Rs. 43,310/- (Rupees forty three thousand three hundred ten only) are lying with the University.

It has been rightly pointed out by the University that the petitioners being the sisters of the deceased employee are not entitled to get any pension for the service rendered by their brother. With regard to last one month's salary, it has been clarified that the said salary was drawn by the deceased employee in the month of May, 1998. That being the position, there is no justification to keep this writ petition pending.

Accordingly, this writ petition is disposed of with a direction upon the University to release the Provident Fund and Gratuity in favour of the legal heirs/successors of the deceased employee subject to production of succession certificate from the competent Court.

Accordingly, WPA 7475 of 2021 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
